RULES OF CONTEST

1.1. Title of the Contest: “PROHACK” (“Contest”)

1.2. Dates of the Contest: from April 27, 2020 to June 25, 2020 (including that date):

Stage I: from April 27, 2020 to June 21, 2020 (including that date) – Participants shall comply with the registration conditions listed on the Contest page (the Registration Period);

Stage II: from May 18, 2020 to June 21, 2020 (including that date) – Participants shall comply with the conditions listed on the Contest page that include downloading of a task, uploading of a solution and performing other actions needed for participation in the game (if any) (the Main Period).

Stage III: from 00:00:00 to 23:59:59 Central European Time on June 25, 2020 – winners of the Contest are determined, and results of the Contest are announced (the Final Period).

1.3. Purpose of the Contest: identify LLC “McKinsey & Company CIS” prospective employees by attracting tech talents.

1.4.The Contest shall be held online on the internet website referred to in par. 1.6. of these Rules of the Contest (“Rules”).

1.5. Organizer of the Contest: LLC “McKinsey & Company CIS” (Primary State Registration Number (in Russian: ОГРН): 1087746280225; Registered Office: Russian Federation, Moscow, Lesnaya Street 5 (“Organizer”).

1.6. Contest venue: web page http://prohack.org/ (“Internet Resource”).

1.7. Any citizen of the country from the list below who has reached the age of majority in accordance with the legislation of the country of his/her citizenship, but not less than 18 (eighteen) years old, is allowed to participate in the Contest. The list of the countries is as follows: the Russian Federation, Ukraine, the Republic of Belarus, the Republic of Kazakhstan, the Republic of Moldova, the Kyrgyz Republic, the Republic of Uzbekistan, the Republic of Tajikistan, the Republic of Azerbaijan, Georgia, the Republic of Armenia; the Lebanese Republic, the Islamic Republic of Iran, the Republic of Iraq, the Syrian Arab Republic, the Kingdom of Bahrain, the Hashemite Kingdom of Jordan, the United Arab Emirates, the Kingdom of Saudi Arabia, the Sultanate of Oman, the Republic of Yemen, the State of Kuwait, the State of Qatar; the Republic of Turkey, the Islamic Republic of Pakistan, the People’s Democratic Republic of Algeria, the Republic of Angola, the Republic of Benin, the Republic of Botswana, the Republic of Burkina Faso, the Republic of Burundi, the Gabonese Republic, the Republic of The Gambia, the Republic of Ghana, the Republic of Guinea, the Republic of Guinea-Bissau, the Republic of Djibouti, the Arab Republic of Egypt, the Republic of Zambia, the Republic of Zimbabwe, the Republic of Cabo Verde, the Republic of Cameroon, the Republic of Kenya, the Union of the Comoros, the Democratic Republic of the Congo, the Republic of the Congo , the Republic of Côte d’Ivoire, the Kingdom of Lesotho, the Republic of Liberia, the State of Libya, the Republic of Mauritius, the Islamic Republic of Mauritania, the Republic of Madagascar, the Republic of Malawi, the Republic of Mali, the Kingdom of Morocco, the Republic of Mozambique, the Republic of Namibia, the Republic of the Niger, the Federal Republic of Nigeria, the Republic of Rwanda, the Democratic Republic of São Tomé and Príncipe, the Republic of Seychelles, the Republic of Senegal, the Federal Republic of Somalia, the Republic of the Sudan, the Republic of Sierra Leone, the United Republic of Tanzania, the Togolese Republic, the Republic of Tunisia, the Republic of Uganda, the Central African Republic, the Republic of Chad, the Republic of Equatorial Guinea, the State of Eritrea, the Kingdom of Eswatini, the Federal Democratic Republic of Ethiopia, the South African Republic, the Republic of South Sudan.

1.8. The Contest shall be conducted in accordance with the existing legislation of the Russian Federation and these Rules.

1.9. The Contest shall not be classified as a lottery or other risk-based event.

1.10. The following individuals shall not be admitted to participate in the Contest: employees of, or other persons cooperating with, the Organizer on a permanent basis, representatives of the Organizer and its affiliated persons, members of their families, as well as employees of other legal entities and other persons involved in organization of the Contest.

1.11. The Organizer shall circulate information about the Contest by placing advertisements and information materials on the Internet Resource.

1.12. The Organizer reserves the right to amend these Rules at any time.

1.13. Involvement of any Participant in the Contest shall be construed as his/her consent to comply with these Rules.


2. CONTEST PROCEDURE

2.1. To become a Participant of the Contest, it shall be obligatory to perform the following actions during the period from April 27, 2020 to June 21, 2020 (including that date):

2.1.1. Visit the Internet Resource.

2.1.2. Complete registration/authorization at the Internet Resource in accordance with the Terms of Use of the Internet Resource published at http://prohack.org/page/terms

One person can register at the Contest only once. It shall not be permitted to register multiple accounts (user records) held by a single Participant, or use (including previously registered) accounts owned by other persons. The Participant warrants and represents that any and all information provided by him/her to the Organizer is true and accurate. If at any stage of the Contest (including the award stage) it transpires that the Participant provided inaccurate data or used accounts owned by other persons, the Organizer may cancel registration of such Participant (delete his/her account) and decline to award the Gift to such Participant.

2.1.3. Any user who has complied with the conditions specified in par. 2.1.2 shall be deemed to have been registered as a participant of the Contest (“Participant”).

2.2. Rules of the game:

2.2.1. To participate in a game Participants should visit page http://prohack.org/page/challenge, read the description of game mechanics, comply with all requisite conditions.

2.2.2. Using the features of the Site, Participants are able to form a team of maximum 4 (four) people (“Team”) or participate solo. Any Participant being a part of a Team is not able to participate solo.

Participants will not be able to make changes to their Team after the first Team’ upload of a solution for the game task, which means that Participants are able to leave their Team or change the Team any time before a Team makes its first upload of a solution for the game task.

2.2.3. To download the game task the Participant should press the “Download” button and download the task.

2.2.4. To upload a solution for the game task the Participant should press the “Upload” button and upload the solution.

2.2.5. Each Team or solo Participant may perform of maximum 20 (twenty) upload submissions with one single solution for each upload submission during the Main Period.

2.2.6. All Participants are able to view their results by visiting https://prohack.org/leaderboard. The points scored by the solo Participants and Teams shall be presented in the consolidated rating table (“Leaderboard”). Leaderboard will show the solo Participant’s and Team’s best solution result.

2.2.7. During the Main Period Leaderboard will be calculated with approximately 80% of the dataset. Any results of the Contest published during the Main Period and until the Final Period are interim.

2.2.8. During the Final Period Leaderboard will be calculated with other approximately 20% of the dataset and the results of the Contest published during the Final Period shall be final.

2.2.9. Winners of the Contest shall be selected based on their places in the Leaderboard, in accordance with the following criteria:

1 (one) Participant or Team taking the 1st (first) place in the Leaderboard shall receive the Main Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 2nd (second) place in the Leaderboard shall receive the Second Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 3rd (third) place in the Leaderboard shall receive the Third Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 4th (fourth) place in the Leaderboard shall receive the Fourth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 5th (fifth) place in the Leaderboard shall receive the Fifth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 6th (sixth) place in the Leaderboard shall receive the Sixth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 7th (seventh) place in the Leaderboard shall receive the Seventh Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 8th (eighth) place in the Leaderboard shall receive the Eighth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 9th (ninth) place in the Leaderboard shall receive the Ninth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 10th (tenth) place in the Leaderboard shall receive the Tenth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 11th (eleventh) place in the Leaderboard shall receive the Eleventh Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 12th (twelfth) place in the Leaderboard shall receive the Twelfth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 13th (thirteenth) place in the Leaderboard shall receive the Thirteenth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 14th (fourteenth) place in the Leaderboard shall receive the Fourteenth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 15th (fifteenth) place in the Leaderboard shall receive the Fifteenth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 16th (sixteenth) place in the Leaderboard shall receive the Sixteenth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 17th (seventeenth) place in the Leaderboard shall receive the Seventeenth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 18th (eighteenth) place in the Leaderboard shall receive the Eighteenth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 19th (nineteenth) place in the Leaderboard shall receive the Nineteenth Gift, as specified in par. 3.1 of these Rules;

1 (one) Participant or Team taking the 20th (twentieth) place in the Leaderboard shall receive the Twentieth Gift, as specified in par. 3.1 of these Rules.

2.3. The commission of the Contest reserves the right to select the winners in disputed situations (e.g., if there are several Participants or Teams eligible for the Gift with identical ratings).

2.4. The Gift shall be awarded to the Winner in accordance with the procedure stipulated by Article 4 of these Rules.

3. CONTEST GIFT FUND

3.1. The gift fund of the Contest shall consist of 20 (twenty) items (“Gifts”):

1st place: 5 000,00 (five thousand) US dollars (Main Gift);

2nd place: 3 500,00 (three thousand five hundred) US dollars (Second Gift);

3rd place: 2 000,00 (two thousand) US dollars (Third Gift);

4th place: 1 000,00 (one thousand) US dollars (Fourth Gift);

5th place: 1 000,00 (one thousand) US dollars (Fifth Gift);

6th place: 1 000,00 (one thousand) US dollars (Sixth Gift);

7th place: 1 000,00 (one thousand) US dollars (Seventh Gift);

8th place: 1 000,00 (one thousand) US dollars (Eighth Gift);

9th place: 1 000,00 (one thousand) US dollars (Ninth Gift);

10th place: 1 000,00 (one thousand) US dollars (Tenth Gift);

11th place: 750,00 (seven hundred fifty) US dollars (Eleventh Gift);

12th place: 750,00 (seven hundred fifty) US dollars (Twelfth Gift);

13th place: 750,00 (seven hundred fifty) US dollars (Thirteenth Gift);

14th place: 750,00 (seven hundred fifty) US dollars (Fourteenth Gift);

15th place: 750,00 (seven hundred fifty) US dollars (Fifteenth Gift);

16th place: 750,00 (seven hundred fifty) US dollars (Sixteenth Gift);

17th place: 750,00 (seven hundred fifty) US dollars (Seventeenth Gift);

18th place: 750,00 (seven hundred fifty) US dollars (Eighteenth Gift);

19th place: 750,00 (seven hundred fifty) US dollars (Nineteenth Gift);

20th place: 750,00 (seven hundred fifty) US dollars (Twentieth Gift).

4. CONTEST GIFT DRAWING

4.1. Winners of the Contest shall be selected by the commission of the Contest upon completion of the Contest (to 23:59:59 Central European Time June 25, 2020). The commission of the Contest shall consist of 3 (three) representatives of the Organizer chosen at the discretion of the Organizer.

Winners of the Contest shall be selected based on their rating in the Leaderboard of the Contest in page at https://prohack.org/leaderboard.

4.2. Only Winners with citizenship of the countries listed in par. 1.7. will be eligible for the Gifts.

4.3. Control of the conduct of the Contest and compliance with these Rules shall be exercised by the Organizer.

5. GIFT RECEIVING PROCEDURE

5.1. Upon completion of the Contest, the solo Participant who or Participant of a Team that has been awarded the Gift shall be notified of such award by the Organizer within 10 (ten) calendar days following the date of completion of the Contest (June 25, 2020), such notice to be sent to the e-mail address provided by such solo Participant or Participant of a Team at the time of his/her registration/authorization (par. 2.1.2 of these Rules).

5.2. To receive the Gift, its owner shall, within 5 (five) business days following the service by the Organizer of the notice declaring him/her the owner of the Gift, ac

knowledge his/her consent to receive the Gift by providing and confirming the information listed in par. 6.5 of these Rules. If the Participant fails to furnish the required information within the time specified by the Organizer, the Organizer may decline to award and transfer the Gift to such solo Participant or Participant of a Team, and name the next following solo Participant or Participant of a Team the holder of the Gift.

5.3. The award procedure:

5.3.1. The Gift will be transferred to the Winner by wire transfer in the currency of the Gift to the bank account of the Participant provided by the Participant in the response to the notice declaring him/her (or a Team he/she is the member of) the winner of the Contest during 14 (fourteen) days from receiving by the Organizer of the Winner’s acknowledgement to receive the Gift provided that the banking details of the Participant’s bank account are correct.

5.3.2. If the Winner is a citizen of the Russian Federation, the Gift will be transferred to the Winner by wire transfer in Russian rubles at the US dollar exchange rate set by the Central Bank of the Russian Federation on the date of transfer.

5.3.3. If the Winner is a Team, the Gift or part(s) of the Gift will be transferred to the Participant(s) chosen by and in amount agreed by all members of such Team or in the order otherwise agreed by the Participants of such Team and the Organizer. In disputed situations the commission of the Contest reserves the right to select the Participant(s) of such Team to whom the Gift (or part(s) of the Gift) will be transferred or decline to award such Team and transfer the Gift to any and all Participants of such Team, and name the next following solo Participant or Team the holder of the Gift. When the Gift is transferred to the chosen Participant(s) of the Team, the Organizer shall not be responsible for distributing the Gift or any part(s) of the Gift among the Participants of such Team.

5.4. The duty of the Organizer to transfer the Gifts to the Participants to whom they have been awarded shall be deemed to have been duly fulfilled at the time of debiting funds from the Organizer’s banking account.

5.5. If the solo Participant or Participant of a Team to whom the Gift has been awarded refuses to receive the Gift, or refuses to provide any information as may have been requested by the Organizer to secure the award and transfer of the Gift, or fails to meet any qualification criteria stipulated by these Rules, the Organizer may, acting in its sole discretion, award the Gift to another solo Participant or Participant of a Team, or dispose of the Gift in any other way not inconsistent with the existing legislation of the Russian Federation and these Rules.

5.6. All expenses and bank commissions related to transfer of the Gifts to the Winners shall be borne by the Organizer. The Organizer shall also discharge the tax agent duties imposed on it by the existing legislation.

5.7. The Organizer shall not be liable for delay or non-fulfillment of transfer of the Gift caused by the fault of any third party.

5.8. The Gift shall only be transferred to the bank account of a natural person, no transfers to bank accounts of legal entities shall be made. The Gift shall only be transferred to the bank account of the Winner opened in the country of the citizenship of the Winner listed in par. 1.7. of these Rules.

5.9. The Organizer shall not be liable for any delay or non-fulfillment of transfer of the Gift to the Participants resulting from the operation of circumstances beyond its control.

5.10. The Gifts that have been transferred in accordance with these Rules to the solo Participants or Participants of a Team to whom they have been awarded, and subsequently returned to the Organizer because the banking details were not found or were incorrect, shall not be repeatedly transferred to the same or another bank account of such Participants.

5.11. Failure of any Participant of the Contest to whom a Gift has been awarded to promptly read the award notice shall not qualify as a good reason for failure of such Participant to receive the Gift.

5.12. Following receipt of the Gift by the Participant to whom it has been awarded, he/she shall bear the risk of its accidental loss or damage, including any such loss or damage caused by any third party gaining unauthorized access to such Participant’s e-mail, banking details, any and all other information or registration/authorization data stored at the Site.

5.13. The Organizer shall not provide any Gift if the Organizer detects any fraud, including but not limited to fraud committed at the time of authorization/registration for participation in the Contest or authorization/registration at the Internet Resource, fraud committed in the course of participation in the Contest, actions by the Participant designed to inflate its rating, etc. The Organizer shall make any determination as to whether any fraud or falsification did, in fact, occur in its sole discretion.

5.14. The Gifts of the Contest may not be exchanged for any other equivalent assets, including cash.

5.15. The liability of the Organizer arising in connection with the transfer of the Gifts shall be exclusively limited by the number and amount of the Gifts specified in these Rules.

5.16. The Organizer reserves the right to decline to transfer any Gift, if the relevant Participant fails to meet any requirements stipulated by these Rules, or comply with any rules governing participation in the Contest as set forth in these Rules.

5.17. The Organizer reserves the right to refrain from engaging in written negotiations or any other contacts with the Participants.

6. RIGHTS AND OBLIGATIONS OF THE PARTICIPANTS

6.1. All Participants shall have the right to receive information about the Contest to the extent and in accordance with the procedure stipulated by these Rules.

6.2. All Participants undertake to carefully review the text of these Rules prior to their participation in the Contest.

6.3. All Participants undertake to comply with these Rules.

6.4. Any solo Participant and Participant of a Team shall have the right to receive a Gift, if the Organizer declares him/her to be a Winner, subject to par. 5.3 of these Rules.

6.5. Any Participant shall have the right to receive a Gift, subject to par. 5.3 of these Rules and if he/she has furnished all documents and/or information as the Organizer may need to award and transfer the Gift, including the following:

  • full name (last name; first name; patronymic - if any);
  • copy of the main ID document (passport or other document in accordance with existing local legislation), containing number of the main ID document (passport data), information about the date of issue of such document, and the issuing authority;
  • information about the place of registration;
  • for the citizens of the Russian Federation: information about the certificate of tax registration of a natural person (if any);
  • source code or model file used to obtain the Leaderboard result (solution);
  • if a Team which the Participant is a member of is declared the Winner: information about the decision on what Participant/Participants of such Team is/are chosen for the receipt of the Gift (or part of the Gift with indication of such part in figures);
  • banking details of the Participant’s bank account.

6.6. Each Participant shall be responsible/liable for:

  • accuracy of the documents and/or information furnished to the Organizer in order to receive the Gift;
  • breach of these Rules of the Contest;
  • provision of false and/or incomplete information in the course of the Contest;
  • infringement of intellectual property rights, as well as any other breaches contained in the solutions for the game task or other information furnished by him/her.

The Participant hereby represents and warrants that the solutions for the game task submitted during participation in the Contest represent original authorship works which do not infringe on intellectual property rights and/or any other third-party rights. The Organizer reserves the right to exclude from participation in the Contest, at any time, any materials with respect to which the Organizer has received from third parties claims regarding infringement of their copyright and/or any other rights. The Organizer may exclude such materials from participation in the Contest without prior notification of the relevant Participant, and without the need to verify veracity of the information, so received, regarding infringement of copyright and/or any other third-party rights. If any solution for the game task submitted during participation in the Contest and/or any materials included in such articles infringe on any third-party rights, the Participant undertakes to settle, at his/her own cost, any claims as may have been asserted by such third parties against the Organizer. The Participant undertakes to indemnify the Organizer for any and all losses and expenses incurred by the Organizer in connection with any such actual or deemed infringement, and protect the Organizer and hold it harmless from any and all claims, whether judicial or non-judicial, related to such infringement.

6.7. By participating in the Contest, the Participant acknowledges that he/she has reviewed, and consents to, all terms and conditions stipulated by these Rules.

6.8. By participating in the Contest, the Participant consents to the Organizer to perform any and all actions necessary to conduct the Contest, award and transfer the Gifts, enable the Organizer to discharge the tax agent duties imposed on it by the existing applicable legislation, publish the results of the Contest and all other necessary actions.

6.9. The Participant of the Contest shall duly note that throughout the duration of the Contest it shall be prohibited by these Rules to publish, circulate or otherwise deliver to any persons, including the users of the Internet Resource where the Contest is conducted, any information which:

  • threatens, discredits, insults, impairs the honor, dignity or business reputation or violates the privacy of, any other users of the Internet Resource or Participants of the Contest;
  • violates the rights of minors;
  • is generally vulgar or indecent, contains obscenities, pornographic images, or sexually-suggestive texts or scenes;
  • contains scenes of violence against, or inhumane treatment of, animals;
  • describes means or methods of suicide, or in any way induces people to commit suicide;
  • promotes and/or incites racial, religious or ethnic hatred or animosity, promotes fascism or racial superiority ideology;
  • contains extremist materials;
  • promotes criminal activities, or contains advice, instruction or guidance promoting commission of criminal acts;
  • contains restricted access information, including but not limited to state and commercial secrets and information about private lives of third parties;
  • advertises or describes in an advantageous light consumption of narcotic substances, contains information about dissemination or drugs, recipes for their preparation, or advice regarding their consumption;
  • is fraudulent;
  • impairs any other rights or interests of natural or legal persons, or is in breach of any requirements stipulated by the existing applicable legislation.

6.10. All Participants shall independently bear all expenses incurred by them in connection with their participation in the Contest (including but not limited to internet access costs).

7. RIGHTS AND OBLIGATIONS OF THE ORGANIZER

7.1. The Organizer undertakes to conduct the Contest, select the Winners from among the Participants of the Contest, and award the Gifts in accordance with these Rules.

7.2. The Organizer shall not be held liable for failure to discharge, or improper discharge of, its obligations resulting from any failure of telecommunication or power systems, operation of malicious software, or bad-faith actions by third parties seeking to gain unauthorized access to, and/or take out of operation, any software and/or hardware used by the Organizer, if that has prevented the conduct of, and/or participation in, the Contest.

7.3. The Organizer shall not be held liable for any damage sustained by any Participant of the Contest as a result of such Participant using the Gifts and/or participating in the Contest.

7.4. The Organizer may withhold the Gift from any Participant who has provided false information about himself/herself, failed to comply with any rules governing provision of information or any required documents, failed to provide such information, or otherwise breached any provision of these Rules.

7.5. To ensure that all Participants participate in the Contest in good faith, and that the Winners are selected and the Gifts are awarded in a fair and equitable manner, the Organizer reserves the right to withhold any Gifts from the Participants who are members of the same family. For the purposes of these Rules, the expression “members of the same family” shall mean all individuals who are related to each other, including spouses, parents, children, brothers, sisters, legal guardians and caregivers. If members of the same family participating in the Contest become the Winners of the Contest, the right to receive a Gift shall accrue to only one of them at the discretion of the Organizer. The Organizer shall independently determine the procedure it shall use to determine whether the Participants of the Contest are members of the same family. If any Participant of the Contest disagrees with the decision of the Organizer to withhold the Gift for the reason described above, the burden of proving the absence of kinship with the other Winners of the Contest shall rest with the Participant from whom the Gift is withheld.

7.6. If any Participant is in breach of any provision of these Rules, the Organizer reserves the right to do, without limitation and acting in its sole discretion, any of the following:

  • block the access previously granted to the Participant to participation in the Contest and/or to the Internet Resources where the Contest is conducted;
  • terminate participation of such Participant in the Contest;
  • decline to award to such Participant any Gifts.

7.7. The decisions made by the Organizer on all matters related to the conduct of the Contest shall be final and not subject to review.

7.8. The Organizer may, in its own discretion, unilaterally terminate, modify, or suspend the conduct of the Contest due to infection with computer viruses, faulty operation of internet or mobile communication lines, discovery of any defects, manipulations, unauthorized interference, falsification, technical failures, or emergence of any other cause beyond control on the part of the Organizer which distorts or impairs execution, safety, integrity or proper conduct of the Contest.

7.9. If the Organizer cannot proceed with any aspect of the Contest as planned for any reason whatsoever, inter alia, due to infection with computer viruses, faulty operation of internet or mobile communication lines, discovery of any defects, manipulations, unauthorized interference, falsification, technical failures, or emergence of any other cause beyond control on the part of the Organizer which distorts or impairs execution, safety, integrity or proper conduct of the Contest, the Organizer may, in its sole discretion, cancel, terminate, modify or suspend the conduct of the Contest, or invalidate any affected bids for participation in the Contest.

7.10. The Organizer reserves the right to impose, at any time, additional technical restrictions preventing bad-faith inflation of ratings. If it is discovered that the rating of any specific Participant is being inflated in bad faith, his/her rating shall be canceled, and such Participant may be barred from further participation in the Contest without explanation or notice. The Organizer shall independently assess whether the Participants receive their ratings acting in good faith using any and all technical capabilities available to the Organizer.

7.11. The Organizer shall not be held liable for inaccuracy or late provision of any information furnished by any Participant, as stipulated by these Rules and required to receive the Gifts.

If necessary, the Organizer may require that the Participants furnish any required additional information for submission to government bodies.

7.12. The Organizer shall not be held liable for the quality of internet connections, quality of work performed by internet providers, compatibility of their hardware and software with the hardware and software used by the Participants of the Contest, any other circumstances lying beyond its control and any, or any ensuing adverse consequences.

7.14. The Organizer shall not be held liable for failure to communicate with any Participant declared to be the owner of a Gift of the Contest attributable to the fact that such Participant has provided inaccurate or outdated information, as listed in par. 6.5 of these Rules, or to any failure of any services, networks or communication channels.

8. FINAL PROVISIONS

8.1. Participation in the Contest shall imply, and be contingent on, review by all users and Participants of, and their full consent to, all provisions of these Rules.

8.2. All disputes related to the Contest shall be resolved in accordance with the existing legislation of the Russian Federation and these Rules.

8.3. The Contest shall not be deemed to constitute a public offer. Participation in the Contest shall not be construed as execution of a contract on the basis of a public offer, nor shall it result in creation of any contractual relations between the Organizer and the Participants.

8.4. For the purposes of advertising in any mass media the Organizer has the right to use any and all information provided by the Participants, and information about any Gift received by any Participant, without prior consent or notification of, and without the payment of any remuneration to, such Participant, in accordance with the terms of Privacy Policy published at https://prohack.org/page/privacy-note

8.5. All decisions made by the Organizer on matters related to the conduct of the Contest and the results of the Contest shall be final and binding on all Participants of the Contest.

8.6. These Rules are made in English and Russian languages. The Russian version of the Rules is available here. In the event of discrepancies as to the terms of these Rules the English version shall prevail.
